Ministerial Directives
A ministerial direction is a direction addressed to the board of a public entity requiring it to act in a particular way in relation to certain aspects of its work. Done under the direction of a supervisor and not involving discretion or policymaking. Ministerial describes an act or a function that conforms to an instruction or a prescribed procedure. It connotes obedience. A ministerial act or duty is a function performed without the use of judgment by the person performing the act or duty. The board and officers of the public entity should follow such a direction unless it is unlawful for some reason.
In my research I have found that some ministerial directions are authorized by legislation. The directions given are found to me mostly written. Sometimes the Act under which a direction is made requires that directions must be noted in the annual report of the public entity or the annual report of the department. A ministerial directive can be issued without the backing of an Act of parliament, which i think is not the best idea. Some directions can emanate from a minister other than the portfolio minister responsible for a particular public entity like the Minister of defence back in 2011, Peter Mackay.
It is part of a minister’s responsibility to parliament to take necessary action to ensure the efficient and proper discharge of the duties of the portfolio department and public entities. This action includes providing directions to public entities. Ministerial directions most often relate to matters of general policy and procedures rather than to the resolution of particular public entity disputes or matters about an individual person. Although I have found many examples in which an individual persons life was hindered by the ministerial directive that Peter Mackay ordered. In November 2011, then Defence Minister Peter MacKay issued a ministerial directive to authorize CSE to spy on Canadians without a warrant. The program authorized by Minister MacKay involved the bulk collection of metadata from individuals around the globe, including Canadians. According to government documents revealed by The Globe and Mail, the program had previously been suspended due to concerns it could lead to warrantless surveillance of Canadians. I find this as undermining human rights! This concern was and is understandable as there are many Canadians who've had their lives turned totally upside down because of this government's privacy deficit.
